Introduction

The general terms and conditions of use of the Isère Attractivité website are effective as of 1 October 2024.

Please read these terms and conditions carefully as they include important information about your legal rights, obligations and available remedies.

By accessing or using the Isère Attractivité website, you agree to adhere to and be bound by these terms and conditions.

Article 1: General provisions and acceptance of the General Conditions of Use

1.1 The site is proposed and operated by the Comité Départemental du Tourisme de l’Isère, a Public Industrial and Commercial Establishment registered under the number 533 096 541, with its head office located at 7 rue Fantin Latour, 38022 Grenoble (postal address: 44 Quai de France, 38024 Grenoble Cedex 1). It is represented by its current president, duly authorised for the purposes of this document. Hereinafter referred to as “Isère Attractivité”, the site is intended to offer users, whether domiciled in France or abroad, the opportunity to benefit from the service.

1.2 These general conditions of use (hereinafter referred to as the “GCU”) govern the access to and use of the site by users. The GCU represent a legally binding agreement between the user and Isère Attractivité and govern access to and use of the site.

1.3 Users must accept the GCU before accessing and browsing the site. Failure to do so will prevent access to the site.

1.4 If the GCU are updated, the User will be asked to accept them again.

 

Article 2: Site access and availability

2.1 The site can be accessed from a computer, tablet computer, mobile phone or any other IT equipment that allows access to the Internet.

Isère Attractivité makes every effort to ensure the availability of the site. However, the user is informed that the availability of the site is subject to a simple obligation of means and acknowledges the characteristics and limits of the Internet and particularly recognises:

  • be aware that the performance of the site depends on the type of connection chosen and the level of demand on the computer servers hosting the site. It is understood that access to the site is only possible via an Internet connection.
  • acknowledge the nature of the Internet network, including its technical performance and response times for consulting, querying or transferring information or content.
  • that it is their responsibility to take appropriate measures to protect their data and/or equipment from contamination by any computer viruses or attempts at intrusion that could harm the proper functioning or damage their equipment.
  • that the site may not be accessible depending on the medium and/or equipment used by the user,
  • certain links accessible on the site may not work if the pages and/or websites they refer to are unavailable.

Consequently, Isère Attractivité cannot be held responsible in any way for difficulties or slowdowns in accessing the Site, for messages not being delivered, for alerts not being published or for any other disruptions or issues related to the accessibility and functioning of the site.

2.2 Isère Attractivité reserves the right to modify or interrupt, temporarily or permanently, access to the Site, including but not limited to maintenance, updates, improvements or changes to the content and/or presentation, without prior notice or compensation of any kind.

2.3 The website may contain links to third-party websites or resources, which may be subject to terms of service (GTC, GSA, GCU, etc.) and personal data protection practices that differ from those of Isère Attractivité. Isère Attractivité is not responsible for the availability or accuracy of these third-party websites or resources or for the content, products or services available from them. Links to these third-party websites and resources should not be construed as an endorsement by Isère Attractivité.

Article 3: Intellectual property

3.1 The site, its content, its functions and the “ALPES ISHERE” brand are protected by intellectual and/or industrial property rights belonging to Isère Attractivité or for which it has a right of use.

3.2 The use of all or part of the Site and/or the request for a reservation does not entail any transfer of intellectual property rights to the user. The user is only granted, for the duration of their connection, a non-exclusive, free, revocable and non-transferable licence to use the Site within the limits of what is expressly provided for in these GCU.

Any reproduction of the content, even partial, is subject to prior written authorisation from Isère Attractivité.

3.3 The user undertakes not to reproduce any of the elements of the site or its content. Any use contrary to this—whether of all or part of the Site, or any of its elements or content—would constitute an infringement, which may result in civil and/or criminal proceedings and expose the offending user to the applicable penalties.

3.4 The user undertakes not to take any action or perform any act that may directly or indirectly infringe upon these rights. Additionally, the user agrees not to use the site’s technology or know-how for commercial purposes to create a website or computer application of any kind, or to offer similar services or services that may compete with those of Isère Attractivité.

Article 4: Guarantees – Liability

4.1 Guarantees – Liability of Isère Attractivité

4.1.1 Isère Attractivité makes no warranties regarding:

  • The uninterrupted operation or availability of the site within a specific timeframe.
  • Continuous, secure or error-free access to the site.
  • The site’s ability to meet the user’s specific needs or expectations.

The site is provided “as is,” with no guarantees or assurances about its functionality or suitability for any particular purpose. The user assumes full responsibility for their use of the site.

No information provided by Isère Attractivité during the use of the site shall be construed as the granting of a guarantee.

4.1.2 Isère Attractivité cannot be held responsible for any direct or indirect damage, loss or cost of any nature resulting from the use of the site, the inability to use it, malfunctions, interruptions due to maintenance, technical failures, interruptions in internet access, viruses, system or connection issues, or any other reason. This includes any damage arising from or related to the use of the site.

4.1.3 Furthermore, Isère Attractivité cannot be held responsible for the following:

  • Infringement of third-party rights by users,
  • Identity theft or impersonation of another user and/or third party,
  • Inability to securely and confidentially maintain information shared during site usage,
  • The content of messages sent through the site.

4.2 Guarantees – Responsibilities of the User

4.2.1 Generally, the User agrees to abide by these GCU in their entirety, as well as all applicable laws and regulations.

4.2.2 The user undertakes to:

  • Not use the site for illegal purposes
  • Respect the image and reputation of Isère Attractivité
  • Not impersonate another User or any third party
  • Not modify or alter all or part of the Site and/or restrict its use by any means whatsoever
  • Not falsify any mention or element of the site
  • Not distribute or attempt to distribute computer viruses or any other harmful elements through the site
  • Respect the rights of third parties, including not using, reproducing, copying, distributing, modifying, representing or distributing text, photographs or any other protected elements or works covered by copyright, trademark law or any other intellectual property right belonging to third parties
  • Not enter the computer system of Isère Attractivité and/or the site host
  • Not alter the content of the site or commit any of the offences punishable by articles 323-1 to 323-7 of the French Criminal Code (“hacking”)
  • Not send unsolicited bulk messages to Isère Attractivité mailboxes (“spamming”), a practice punishable under article 226-18 of the French Penal Code
  • Not extract or collect content from the site, especially through the use of automated programs
  • Not transmit funds of illegal origin or provenance through the site or the payment system provided
  • Not transmit via the site, including through the contact form, any content (e.g., files, comments, videos, audio recordings) that is illegal or harmful to third parties. This includes, but is not limited to, content that is abusive, racist, sexist, xenophobic or paedophilic.

Failure to comply may result in Isère Attractivité taking legal action, including criminal and/or civil responsibility, against offending users.

 

Article 5: Reporting of Illicit Content
In accordance with applicable legislative and regulatory provisions, Isère Attractivité allows users to report illicit content (especially in cases of infringement of intellectual property rights or violations of legal and/or regulatory provisions).
To do so, users must contact Isère Attractivité via the contact form on the Site (accessible via the following link: alpes-isere.com/contact), providing all the following information:

  • The date of notification
  • Their first name, last name and email address
  • A description of the disputed facts and their exact location (pages)
  • The reasons why the content should be removed, including references to legal provisions and justifications of facts.

Article 6 : Sources of Tourist Information

The tourist information on the alpes-isere.com website is sourced from:

Site Partners: Information published on the site is verified by Isère Attractivité before going online. To report errors or request corrections, contact Isère Attractivité via the contact form. This includes editorial pages, recipes or portraits/interviews.

Apidae Tourist Information Network: The tourist information in the guide section on alpes-isere.com uses data from the Apidae Tourisme network, a collaborative Tourist Information System (SIT). As this data comes from various contributors (e.g., tourist offices, service providers, Département, Isère Cheval Vert, Clévacances, Gîtes de France Isère), Isère Attractivité is not responsible for its completeness. Any corrections should be addressed to the respective tourist office.

Article 7: Booking

7.1 Use of the Open Experience Regional Marketplace

The www.alpes-isere.com website integrates the Open Experience platform, allowing visitors to book a range of tourist services, including accommodation, activities and tickets. These services are accessible via “Book” buttons on the site. Tourism service providers manage and publish their offers through tools provided by Alliance Réseaux, which handles and shares booking data with Isère Attractivité.

7.2 Role of Isère Attractivité

Isère Attractivité neither owns, creates, sells, resells, supplies, controls, manages, nor offers any tourist services. All bookable offers on the website are provided exclusively by independent service providers. Isère Attractivité’s role is limited to providing a platform that connects tourism service providers with Users, enabling them to access a booking service for tourism activities in Isère. Notably, Isère Attractivité does not earn any commission on sales made through the site.

7.3 Managing Advertisements and Payment Data

Isère Attractivité hosts the advertisement content, including texts, photos, prices, duration and services offered. However, payment details remain accessible only to Alliance Réseaux and the service provider offering the service.

7.4 Acceptance of the Service Providers’ General Terms and Conditions of Sale

The general terms and conditions of each tourist service provider are accessible at the time of booking confirmation. To complete any reservation, you must explicitly accept these terms. Isère Attractivité does not guarantee that the service providers’ terms and the services they offer comply with applicable legal and regulatory provisions, including consumer law.

7.5 Liability and Commercial Transactions

Isère Attractivité is not a party to any booking, buying or selling transactions and cannot guarantee that these transactions will be successfully completed between sellers and buyers. It accepts no liability in case of disputes or damages arising from such transactions. All statements and service or product offers on this site are the sole responsibility of their respective authors.

7.6 Reservation contracts

When users make a reservation through the site, they enter directly into a contract with the selected host. Isère Attractivité is not a party to this contract. To confirm the booking, users must agree to the host’s general terms and conditions of sale.

To make a reservation, users must review the dedicated page, which lists all applicable charges, before proceeding with their booking.

Reservations can be made in two ways:

  • Online Payment: Users pay online and receive a booking confirmation from Isère Attractivité, creating a legally binding agreement between the user and the host.
  • Booking Request: For hosts not offering online payment, users submit a booking request. If the host declines, Isère Attractivité bears no responsibility. If the host accepts, a legally binding agreement is established between the user and the host.

7.7 Cancellations and Modifications

Isère Attractivité does not process requests for cancellations, modifications, refunds or any other matters between users and hosts. All such requests must be directed to the host, as Isère Attractivité is not involved in managing these aspects of the user-host relationship.

7.8 Booking “Weekends”

The www.alpes-isere.com website enables users to book holidays with hosts providing accommodation in the Isère department. These stays can be found in the “Weekends” section of the site. The services offered by the hosts include the rental of various types of accommodation such as gîtes, chambres d’hôtes, campsites, hotels and more, for holidays or other purposes. Please note that other activities offered by the hosts are not available for booking through the site.

As with other services available on the alpes-isere.com website, Isère Attractivité does not own, create, sell, resell, supply, control, manage or offer any accommodation. These services are provided exclusively by the hosts through the website. Isère Attractivité’s role is to provide the platform where hosts can offer their accommodation and users can access a curated selection of holidays in Isère. Isère Attractivité does not receive any commission from bookings made via the site.

Isère Attractivité undertakes to do its utmost to ensure that the accommodation offered in the “Week-end” section of the site provides the best possible quality of stay for users wishing to make a reservation. To this end, Isère Attractivité will strive to offer:

  • An experience built around customers: The offer combines accommodation and activities at the heart of a personalised experience, which is constantly renewed to meet the demand for short breaks, available year-round depending on the season and individual leisure time.
  • A shared approach: The offer is a result of a collaborative effort between Isère Attractivité and many of the region’s tourist offices, ensuring a diverse and inclusive range of options.
  • A personalised approach: By offering activities near users’ accommodations, Isère Attractivité ensures that visitors can create a tailor-made holiday experience, keeping control of their itinerary.
  • A social dimension: The platform encourages collaboration by facilitating access to content produced by other visitors, allowing tourists to share experiences and discover what others recommend.
  • Transparency: Clear access to all necessary information, such as availability, location, prices, customer reviews and direct contact with service providers, ensures that users are fully informed to prepare their stay.
  • A commitment to quality: Hosts must undergo a training program to ensure they provide an exceptional experience, committing to an impeccable quality of service and hospitality.

However, despite these factors, Isère Attractivité does not verify or guarantee the quality of the services provided by the hosts, nor the accuracy of the advertisements in relation to the actual services offered by the hosts.

Once a booking has been made, the user may be asked by Isère Attractivité to provide feedback on their holiday after it has been completed. The user will receive an email to the address provided at the time of booking. The review will be visible to both Isère Attractivité and the host. Users wishing to leave a review will have a “free field” in the “Comments” section on the review page, where they are encouraged to share their impressions and opinions. Users agree not to leave comments containing offensive, racist, sexist, xenophobic, paedophile or defamatory content. Isère Attractivité reserves the right to publish or withhold any review at its discretion, which the user acknowledges and accepts. The user also understands that the customer reviews published on the site regarding a host are at Isère Attractivité’s discretion and do not necessarily reflect all the reviews submitted by various users.

Article 8: Protection of Personal Data and Cookies

8.1 The protection of users’ personal data is governed by the Privacy Policy, which can be accessed by clicking on this link.

8.2 It is specified that, in any event, if:

  • The user does not make a reservation via the site,
  • The user does not subscribe to the Isère Attractivité newsletter,
  • The user does not contact Isère Attractivité using the contact form on the site,

No personal data is collected or processed by Isère Attractivité.

 

8.3 The site may ask users to accept cookies for statistical and display purposes. A cookie is a piece of information placed on your hard drive by the server of the site you are visiting. It contains several items of data stored in a simple text file that a server can access to read and record information. Certain parts of the site cannot be used without accepting cookies.

Article 9: Liability

9.1 Isère Attractivité may be held liable under applicable legal provisions in the event of intentional and serious misconduct by Isère Attractivité, or in the case of a breach of its essential contractual obligations.

Isère Attractivité’s liability is limited to foreseeable and typical damage that may occur.

All other liability is excluded.

9.2 To the fullest extent permitted by applicable law and regulations, users indemnify Isère Attractivité from and against any and all claims, liabilities, damages, losses and expenses, including reasonable legal fees, arising in any way whatsoever from any failure to comply with these Terms and Conditions, any inappropriate use of the Site and any breach of any law, regulation orr third-party right causing prejudice to Isère Attractivité.

Article 10: Applicable law

These Terms and Conditions (GCU) and the transactions arising from them are governed by and subject to French law.

The contract is written in French. In the event that it is translated into one or more foreign languages, only the French text will be deemed authentic in the event of a dispute.

 

Article 11: Disputes

11.1 Any disputes arising from the application of these general conditions of use, concerning their validity, interpretation, performance, termination and consequences, which cannot be resolved between Isère Attractivité and the user, will be submitted to the competent courts under the conditions of common law.

11.2 The user is informed that they may, in any event, have recourse to conventional mediation, in particular with the Consumer Mediation Commission (article L.612-1 of the Consumer Code) or with existing sectoral mediation bodies, the references of which appear on the site or any alternative dispute resolution method (e.g., conciliation) in the event of a dispute.

11.3 The European Commission has established a dispute resolution platform to collect complaints from consumers following online purchases and forward them to the relevant national ombudsman.

However, Isère Attractivité is not obligated and does not commit to using an alternative dispute resolution method to resolve any disputes with users.

Article 12 : General provisions

12.1 These Terms and Conditions (T&Cs), along with any additional conditions, policies or legal notices that complement them, constitute the entire contractual agreement governing the relationship between users and Isère Attractivité regarding access to and use of the site.

12.2 If any provision of these T&Cs is declared null, invalid or unenforceable, that provision will be annulled without affecting the validity and enforceability of the remaining provisions.
